  • First DUI if aged under 21: License suspended for 6 months, DUI school and a fine of $210 if less than 0.08 percent level of alcohol concentration. License suspended for one year if that level is over 0.08 percent.

Criminal penalties:

The O.C.G.A. § 40-6-391 lists offenses for driving under the influence of alcohol:

  • Fines range from $300 to $1,000, prison time ranges from 10 days to a year, and DUI school and community service are required.
  • For a first DUI conviction without a 12 month time in prison, offenders must participate in a year long probation program, although that excludes days that were spent in prison.
